These Terms & Conditions (“Terms”) govern your use of our services, website, and SMS text messaging program. By using our services or opting in to receive SMS messages, you agree to these Terms.

1. SMS Text Messaging Program Terms

By opting in to our SMS program, you agree to the following terms:

1.1 Program Description

The A+ Auto Repair & Tires SMS Program is a marketing text program. We send recurring automated marketing text messages only to customers who have opted in through the sign-up form on our website. Messages include:

• Special offers and discounts, such as our 10% off sign-up offer
• Monthly specials on services such as brakes, tires and oil changes
• Seasonal promotions
• When you reply YES to a promotion, we text you that offer’s code

1.2 Message Frequency

Up to 4 messages per month. Message frequency varies.

1.3 Message and Data Rates

Message and data rates may apply. A+ Auto Repair does NOT charge you for receiving text messages, but your mobile carrier may charge you for sending and receiving text messages based on your service plan. Contact your carrier for pricing details.

1.4 Supported Carriers

Our SMS program is compatible with all major U.S. mobile carriers including:

• AT&T
• T-Mobile
• Verizon Wireless
• Sprint
• US Cellular
• Boost Mobile, Cricket, MetroPCS, and other regional carriers

Carriers are not liable for delayed or undelivered messages.

1.5 Opt-In Process

You may opt in only by completing the sign-up form at aplusautosj.com/sms-sign-up and checking the consent box, which is unchecked by default.

Consent is NOT a condition of any purchase. You do not have to consent to receive marketing text messages to purchase our products or services.

1.6 Opt-Out Instructions

You can opt out at any time by:

• Replying STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any message
• Calling us at (408) 520-7737
• Visiting our shop and requesting removal from staff

After opting out, you will receive one final confirmation message, and you will no longer receive text messages from this program.

1.8 Privacy

2. Service Terms

2.1 Auto Repair Services

All auto repair services are provided in accordance with California Bureau of Automotive Repair (BAR) regulations. Written estimates are provided before any work begins.

2.2 Warranties

We offer a 12-month/12,000-mile warranty on parts and labor for most repairs. Specific warranty terms are provided at the time of service.

2.3 Payment

Payment is due upon completion of service. We accept cash, credit cards, debit cards, and approved financing options.

3. Website Terms

3.1 Use of Website

By using our website, you agree to use it only for lawful purposes. You may not use our website to:

• Violate any applicable law or regulation
• Transmit malicious code or spam
• Attempt to gain unauthorized access to our systems

3.2 Intellectual Property

All content on this website (logos, text, images) is the property of A+ Auto Repair & Tires and protected by copyright laws.

4. Limitation of Liability

To the maximum extent permitted by law, A+ Auto Repair & Tires shall not be liable for indirect, incidental, or consequential damages arising from the use of our services or SMS program.

5. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in Santa Clara County, California, in accordance with the American Arbitration Association rules.

6. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via website notice or SMS to opted-in customers.

7. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
